Terms of use for advertisers who place campaigns on EduTalkz.
Terms of use for advertisers
1. Introduction
Through the EduTalkz streaming service, healthcare professionals can view talks, lectures and other educational content. The platform also displays adverts for goods and services (the “Service”).
2. Vetting of adverts
EduTalkz may review any advert before it is shown on the Service. We may refuse to show an advert. We may also stop showing an advert (temporarily or permanently) at any time, without reason and without notice. If we decline or stop an advert, we will let the advertiser know.
3. Targeting of speakers
Adverts may not be aimed at, or appear to target, any specific speaker, institution or presenter whose content appears on EduTalkz.
4. Laws and standards
The advertiser warrants and confirms that:
- its advert does not infringe any rights of any other person, including intellectual property rights; and
- its advert complies with all laws that apply to advertising of that kind, as well as accepted advertising standards and norms, including those set by any regulatory or consumer protection body; and
- its advert is assigned to the correct advert grouping on EduTalkz.
The “correct advert grouping” is based on the type and classification of medicine or medical device in terms of the Medicines and Related Substances Act, the schedule of the medicine (including complementary medicines), or the class of the medical device, and whether it may be shown to the public or only to registered healthcare practitioners.
5. Indemnity
The advertiser indemnifies EduTalkz and holds it harmless against all loss, damage, costs and expenses that EduTalkz may suffer or incur in connection with its advert.
6. Miscellaneous
- The advertiser agrees that EduTalkz may at any time transfer, cede, delegate or assign any or all of its rights and obligations under these terms, without the advertiser’s consent.
- These terms apply for the benefit of and are binding on EduTalkz, its successors and assigns, and on the advertiser and its successors.
- These terms are governed by the laws of the Republic of South Africa.
- If EduTalkz does not exercise or enforce a right under these terms, that does not mean the right is waived.
- These terms form the whole agreement between EduTalkz and the advertiser in relation to the display of the advert on the Service.
- Headings are for convenience only and do not affect interpretation.
